Offer in Compromise:
An Offer in Compromise is a onetime settlement with the IRS based primarily on assets and the taxpayer’s ability to pay the tax debt back based on income and expenses that the IRS will allow. The process takes about 6 months. The IRS will cease collection action while an Offer is pending. The taxpayer must be in compliance with tax filing before submitting an Offer in Compromise. Personal, business taxes and payroll taxes including civil penalties can be compromised in an Offer in Compromise. The IRS has strict guidelines in the submission and acceptance of an Offer in Compromise. If your wages have been levied or the IRS is threatening to levy, we can help. We can put a stay of collection on your account or have the levy released if one has already been sent to your employer. Knowing what a hardship it can be to have your wages seized, we move quickly to have the levy released. An Installment Agreement is a payment plan set up with the IRS. If the tax debt is under $25,000 one can usually be set up by streamline method over 5 years. If the tax debt is over $25,000 but under $100,000 financial information must be provided and the case will need manager approval. If the case is over $100,000 it is handled in the Buffalo dept. of the IRS or the high dollar unit. Back Tax Solutions:
If you need to file the current year, or it has been twenty years since you have filed, we offer professional and prompt tax preparation. If you do not have the records, we can obtain them from the IRS, usually within 48 hours. If it has been many years since you filed have a tax return, it might be possible to close out some of the years. The IRS will require you to be in compliance with the filing of any tax returns before an Installment, Offer in Compromise, Uncollectible or having a levy released. Payroll taxes include 940, 941 taxes and civil penalties. The IRS is aggressive in collecting payroll taxes that have not been paid. The IRS can assess the Trust Fund Recovery Penalty against any person who is responsible for collecting or paying withheld income taxes and employment taxes or for paying collected excise taxes and willfully fails to collect or pay them. The amount of the penalty is equal to the unpaid income taxes withheld plus the employee’s portion of the withheld FICA taxes. Once the amount is assessed the IRS can take collection action against personal assets of the person to whom it was assessed. IRS Audit Defense:
An IRS audit usually begins with a letter from the IRS stating ''Your return has been selected for an examination.'' This does not mean you are dishonest and the inquiry does not necessarily mean you will be assessed more tax. There are 4 kinds of IRS audits:1. Correspondence Audit - a letter from the IRS Service Center requesting that you send additional information to support the deductions on your return.
2. Office Audit - Also usually arrives by mail. The letter identified specific items on the return and asks for you or your representative to bring in certain substantiation and/or documents to the local office for the auditors review.
3. Field Audit - An IRS agent will personally notify you that your return has been selected for an audit. The agent will want to conduct the audit at your place of business.
4. TCMP (Taxpayer Compliance Measurement Program) - Primarily an information audit for the IRS to update their scoring system.

Uncollectible (section 53):
Uncollectible is a temporary stay of collection due to a hardship on the taxpayer. This can be unemployment, medical, family or any other temporary hardship making it impossible for the taxpayer to set up an Installment Agreement or pay the tax debt back at this time. It will not reduce the taxes due or stop interest and penalties from running, but will take the account out of collection until the temporary circumstances change.
